Terms of Service

Last updated

These Terms of Service ("Terms") govern your use of SayMail's website at https://saymail.ai, the SayMail web application at https://app.saymail.ai, and the SayMail mobile application (together, the "Service"). By creating an Account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The following terminology applies to these Terms, our Privacy Policy, and any disclaimer notices: "You" and "Your" refer to you, the person or entity using the Service. "The Company", "SayMail", "We", "Our", and "Us" refer to SayMail, a company organized under the laws of Delaware, United States. Any use of the above terminology or other words in the singular, plural, or capitalization is taken as interchangeable and therefore as referring to the same.

What SayMail is

SayMail is an AI email client. Once you connect an email account, the Service reads your mail to show it to you, sorts and summarizes it, and drafts, sends, archives, labels, and schedules on your behalf when you ask it to, by voice or by text. Connecting a calendar, a file store, or a task tool extends what the assistant can do. The assistant acts only on your instructions; you remain responsible for the emails you send and the actions you confirm.

Eligibility and accounts

You must be at least 13 years old, or the age of digital consent in your country if higher, to use the Service. If you use the Service on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.

You sign in to SayMail with a Google or Microsoft account. You are responsible for keeping that account secure and for everything that happens under your SayMail Account. Tell us at [email protected] right away if you believe your Account has been accessed without your permission.

Connected accounts and third-party services

To work, the Service needs your permission to access your email account and, if you choose, your calendar, Google Drive, Notion, Todoist, Linear, Zoom, or other services we support ("Connected Services"). You grant that permission through each provider's own consent screen, and you can revoke it at any time from the provider or from within SayMail.

Your use of a Connected Service is also subject to that provider's own terms. In particular, SayMail's use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements, as described in our Privacy Policy. We are not responsible for the availability, accuracy, or behavior of any Connected Service, and a change on the provider's side may limit or interrupt features that depend on it.

AI features

Summaries, sorting, drafts, and the voice assistant are generated by artificial intelligence. They can be wrong, incomplete, or miss context. The Service is built so that sending, scheduling, and other actions with outside effect happen only after you ask for them and, where the design calls for it, confirm them. Review what the assistant proposes before you confirm it. You are responsible for the content of every message sent from your account through the Service, including messages drafted by the assistant.

Subscriptions, trials, and billing

SayMail is a paid subscription. New accounts may start with a 7-day free trial; after the trial, or immediately if no trial applies, the plan you chose renews automatically at the then-current price until you cancel. Prices, plan limits, and what each plan includes are shown in the Service at the time you subscribe.

Billing is handled by Stripe. By subscribing you authorize us and Stripe to charge your payment method for each renewal. You can cancel at any time from your Account; cancellation stops future charges and your access continues until the end of the paid period. Refunds are governed by our Refund Policy.

We may change prices or plan contents. If a change affects a plan you are on, we will give you notice before it takes effect at your next renewal.

Acceptable use

You agree not to:

  • use the Service to send spam, unsolicited bulk mail, phishing, or messages that are unlawful, defamatory, or infringing;
  • use the Service in a way that violates the terms of your email provider or any Connected Service;
  • attempt to access another person's account or data, or probe, scan, or test the vulnerability of the Service without our written permission;
  • interfere with the Service, its infrastructure, or the providers it connects to, including by exceeding reasonable request volumes or circumventing plan limits;
  • reverse engineer, scrape, or copy the Service or its content, except as permitted by law;
  • resell, rent, or provide the Service to third parties as a service bureau; or
  • use the Service to build a competing product by systematically extracting its outputs.

We may suspend or terminate an Account that we reasonably believe is violating these Terms or putting the Service, other users, or a Connected Service at risk.

Your content

You retain all rights to your email, files, calendar data, and anything else the Service accesses or that you provide to it ("Your Content"). You grant us only the limited license needed to operate the Service for you: to fetch, display, process, transmit to the providers you use, and act on Your Content as you instruct. We do not claim ownership of Your Content, we do not use it for advertising, and we do not use it to train artificial intelligence models. How we handle Your Content is described in our Privacy Policy.

Intellectual property

Unless otherwise stated, SayMail and its licensors own the intellectual property rights for the Service and all material on the Website, including the software, design, logos, and text. All intellectual property rights are reserved. You may use the Service and access this material for your own personal or internal business use, subject to these Terms. You must not republish, sell, rent, sub-license, reproduce, duplicate, copy, or redistribute material from SayMail except as these Terms allow.

Termination

You can stop using the Service and delete your Account at any time from Settings. Deleting your Account revokes the Connected Service grants we hold for you and permanently removes your data from our systems, as described in the Privacy Policy.

We may suspend or terminate your access if you breach these Terms, if we are required to by law, or if we discontinue the Service. Where practical we will give you notice and a chance to export what you need. Sections of these Terms that by their nature should survive termination, including intellectual property, disclaimers, and limitation of liability, survive.

Hyperlinking to our content

You may link to our home page, to publications, or to other Website information so long as the link: (a) is not in any way deceptive; (b) does not falsely imply sponsorship, endorsement, or approval of the linking party and its products or services; and (c) fits within the context of the linking party's site. Without prior written permission, you may not frame our web pages in a way that alters their visual presentation, and you may not use SayMail's logo or other artwork for linking without a trademark license agreement. We reserve the right to request that you remove any link to our Website, and you agree to do so promptly upon request.

If you find a link on our Website that is offensive for any reason, you may contact us at any time. We will consider requests to remove links, but we are not obligated to do so or to respond to you directly.

Disclaimer

The Service is provided "as is" and "as available". To the maximum extent permitted by applicable law, we exclude all representations, warranties, and conditions relating to the Service, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, that AI-generated output will be accurate, or that any Connected Service will remain available.

Nothing in this disclaimer will:

  • limit or exclude our or your liability for death or personal injury;
  • limit or exclude our or your liability for fraud or fraudulent misrepresentation;
  • limit any of our or your liabilities in any way that is not permitted under applicable law; or
  • exclude any of our or your liabilities that may not be excluded under applicable law.

Limitation of liability

To the maximum extent permitted by applicable law, SayMail and its officers, employees, and Service Providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or business, arising out of or in connection with the Service or these Terms, even if advised of the possibility of such damages. Our total liability for all claims relating to the Service in any twelve-month period will not exceed the amount you paid us for the Service in that period.

The limitations in this section and in the Disclaimer: (a) are subject to the exceptions listed in the Disclaimer; and (b) govern all liabilities arising under these Terms, including liabilities arising in contract, in tort, and for breach of statutory duty.

Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules. Any dispute arising from these Terms or the Service will be brought in the state or federal courts located in Delaware, and you consent to their jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction.

Changes to these Terms

We may update these Terms from time to time. We will post the new Terms on this page and update the "Last updated" date. For material changes, we will also let you know by email or by a notice inside the Service before the change takes effect. Continuing to use the Service after the change takes effect means you accept the updated Terms.
